Lawsuit between Gardner VFD & Gardner FPD

The Morris Daily Herald has an article about the culmination of a lawsuit against the Gardner FPD by the Gardner VFD.

The appellate court has upheld a previous court’s decision regarding litigation between the Gardner Fire Protection District and the former Gardner Volunteer Fire Department – leaving the district victorious.

“The decision affirmed in total our motions. Unless the department seeks some type of petition to review from the supreme court, the matter is over,” said attorney for the fire protection district, Richard Porter of Hinshaw & Culbertson LLP Wednesday. “I personally don’t believe the Supreme Court would accept this case for review,” he said.

Contact with the department’s attorney, Tim Rathbun of Rathbun, Cservenyak & Kozol, was not immediately returned Wednesday. A call to former Fire Chief Randy Wilkey also was not returned.

The litigation first began years ago when the fire protection district terminated its contract for services with the volunteer fire department. Under that arrangement, the department, run by Wilkey, provided fire protection services to Gardner using tax dollars provided by the district.

The district accused the department of using its money for legal fees to argue an election for district trustees, Porter said. In addition, the department had a credit card balance of about $47,000 it refused to account for. The department argued then it could not misappropriate its own funds.

The department then filed suit that the district terminated their contract “arbitrarily and capriciously,” and it was not in the district’s discretion to do so.

About a year ago, Judge Robert Marsaglia ordered the fire protection district had the right to terminate the contract of the volunteer fire department when the department no longer provided satisfactory services. The department filed an appeal of Marsaglia’s decision.

Gardner officials were notified Tuesday that the Appellate Court of Illinois’ Third District ruled the original court properly granted the fire district’s motions.

“We cannot say that the district exercised its discretion arbitrarily or capriciously when terminating the agreement based upon the department’s refusal to comply with its reporting duties,” states the appellate court’s order. “It would be disingenuous of the department to claim that the parties’ reasonable expectations included denying the district the ability to review the department’s accrual of the credit card charges,” it states later. “With an eye toward financial oversight, the agreement calls for the department to provide rather detailed budgets.”

The whole battle between the district and department started when former department chief Wilkey refused to give the district board original receipts from which to pay the department’s bills, according to previous statements by district representatives and Wilkey. Eventually, when Wilkey refused to give originals, the district refused to pay the bills. This led to the feud going to court and the district no longer recognizing Wilkey as chief.

La Grange Park house fire, 2-19-14

 Four people were injured after a fire broke out at a home in west suburban La Grange Park.

Emergency crews responded at 3:36 p.m. to the blaze at a two-and-a-half-story home in the 500 block of North Kensington Avenue, according to a statement from La Grange Park Fire Department Chief Dean Maggos.

An unspecified number of people in the house said they heard what sounded like an explosion in the basement of the home before they saw smoke and ran outside. Everyone inside, including several dogs, escaped before firefighters arrived, Maggos said.

Two children and two adults were taken to Adventist Hinsdale Hospital with smoke inhalation, and their injuries were not thought to be life-threatening, officials said.

Damage to the home was “substantial,” but there was not an exact estimate on the value of damages, Maggos said.

The cause of the fire is under investigation.

Sentencing for theft from Aurora FF’s Credit Union

The former president of the Aurora Firefighters Credit Union was sentenced to three years of probation, 150 days of electronic home monitoring and 30 days in jail after admitting to stealing from the union. Anne M. Schaal, 67, of the 0-99 block of Birchwood Court, Sugar Grove, was arrested in September 2012 and accused of stealing $36,000 over a five-year span.

Schaal pleaded guilty last week to felony theft and could be resentenced to up to seven years in prison if she violates her probation, according to Kane County court records. Schaal stole money from the union to feed a gambling addiction, according to papers filed by her husband for a divorce that was finalized in 2012.

Aurora police said they began investigating Schaal in December 2011 and she was accused of stealing between January 2006 and November 2011.

Under a plea agreement approved by Judge Clint Hull, Schaal must pay $4,565 in court fines and costs and is to have no contact with the union. Her 30-day jail sentence can be cut in half for good behavior.

According to a lawsuit filed by the union against Schaal, she was president from July 1996 through November 2011 and stole the money … using union credit cards and “phantom payments” in the union ledger. The lawsuit was dismissed in September 2013 after Schaal and the credit union reached an out-of-court settlement, according to court records.

Wade Joyner, an attorney representing the credit union in the lawsuit, said Schaal made a payment to the union to settle claims for damages. Joyner refused to say what Schaal paid. “The Aurora Firefighters Credit Union accepted what she was willing to do to resolve it,” Joyner said.

The credit union represents nearly 600 members.

Schaumburg may increase job prerequisites

The Daily Herald has an article discussing a possible increase in the requirements to become a Schaumburg firefighter.

Schaumburg’s public safety committee has recommended lowering the maximum starting age from 40 to 35 for newly hired police officers and firefighters, as well as requiring new firefighters to hold bachelor’s degrees as village police officers already do.

The recommended change to the age requirements is being made to comply with current state statute. But the statute is very detailed and contains many exceptions — including for having served in the military, Assistant Village Attorney Rita Elsner said.

The statute also makes 21 the minimum age for new hires. Schaumburg Police Chief James Lamkin said this implies an expectation of a certain level of maturity among police officers.

And with Schaumburg’s long-running requirement for its police officers to hold any type of bachelor’s degree, there’s an overall breadth of knowledge and experience the village expects from its officers, Lamkin said.

Schaumburg will probably be more rare in the near future for requiring any kind of bachelor’s degree for its new firefighters, Assistant Village Manager Paula Hewson said. Until now, the village has required either an associate degree or a bachelor’s degree.

But new applicants have already been receiving preference points for having bachelor’s degrees, putting them higher up on the hiring list, Hewson said.

Because of this, among the pool of candidates seeking jobs at the Schaumburg Fire Department, the new requirement probably won’t make much difference in whom is actually hired, Hewson added.

The statute applies when a new hiring list is being created, and most lists are valid for two or three years after testing, she said.

Approximately 390 candidates tested this month for Schaumburg’s police officer hiring list, Lamkin said.
