Chicago FD Firefighter Jermaine Pelt LODD 4-4-23

One of the men charged with setting an arson fire that resulted in the death of an on-duty Chicago firefighter has filed a federal lawsuit against four Chicago police officers and the city, claiming they ignored “large amounts” of exculpatory evidence proving he had no role in the case.

Prosecutors dropped all charges against Martez Cristler in October, 72 days after he was jailed on murder and arson counts. The other two men are still fighting the charges.

Jermaine Pelt, a veteran of the Chicago Fire Department, died from carbon monoxide poisoning, smoke and soot inhalation after debris and a dresser fell on top of him, knocking off his air mask, as he fought the blaze in the 12000 block of South Wallace on April 4, 2023, officials said. He would have turned 59 the next day.

Prosecutors charged the building’s owner, Cristler, and a third man, saying they set the fire so the owner could claim an insurance payout. The state claimed that surveillance video showed Cristler’s car circling the block and said a phone number “associated with” Cristler pinged in the area before, during, and after the fire started. They said he and the third man repeatedly called each other as they circled the block in their vehicles. Cristler claims that he was sleeping at the home he shares with his mother and younger brothers at the time of the fire.

The federal lawsuit claims that the phone number in question belongs to Cristler’s father and was never in Martez’s name. It was allegedly added to his mobile account in July 2023, three months after the fire and a year before charges were filed. The lawsuit also claims that Cristler’s father bought and drove an Infiniti he registered in his son’s name, and Cristler drives a 2014 Jaguar that his grandfather bought him.

The lawsuit alleges “egregious misconduct” by CPD investigators who “knew” he did not commit the crimes. He sat in Cook County jail from July 3 to October 3, 2024. Prosecutors dropped the case a week later. The lawsuit alleges illegal detention and malicious prosecution under state and federal law.

The Cook County Record was the first to report on the lawsuit.

Chicago Firefighter Jermaine Pelt

The cause of death for fallen Chicago Firefighter Jermaine Pelt was revealed by the Cook County Medical Examiner’s office on Wednesday afternoon.

Pelt, 49, died of carbon monoxide toxicity due to inhalation of smoke and soot while battling a fire in the city’s West Pullman neighborhood. Two other firefighters were injured in the blaze.

Pelt, a father of two who recently celebrated his 49th birthday, had been a member of the department since 2005 and worked in the city’s Roseland community for his entire career.

The blaze started around 3:30 a.m. Tuesday in the 12000 block of South Wallace Street. before spreading to two other buildings.

Pelt was manning a hose in one of the burning buildings when conditions worsened. All firefighters were ordered out of the building, but Pelt went down just as that order was being issued.

He was quickly found near the hose line by his lieutenant – who was also hospitalized but is in good condition – and brought out for treatment.

Despite the best efforts of firefighters and paramedics, they worked on Jermaine doing CPR all the way from the scene to Christ Hospital where he passed away.

Chicago Firefighter Jermaine Pelt died after an extra-alarm fire in the West Pullman neighborhood Tuesday morning. The beloved father of two has been with the department for 18 years, serving the Roseland community.

Just celebrating his 49th birthday last month, Pelt was with his crew early Tuesday morning fighting a fire near 120th and Wallace streets. The fire started in a home and quickly spread to the adjacent buildings. That’s where Pelt was was on a hose line inside the home when conditions worsened and he and his crew had to get out. When his lieutenant didn’t see him come out, they knew something was wrong. A mayday was called and he was quickly found near the hose line and brought out for treatment.

“The chief asked us if we wanted to be out of service and we said no, because this is what Jermaine would do. Jermaine wouldn’t take the day off,” said CFD Capt. Rory Ohse.

Pelt recently walked his daughter down the aisle, and she is on her honeymoon right now. She got the news on Tuesday morning, and is rushing home. His family took part in his procession to the medical examiners office. Pelt also left behind a 6-year-old. He was a soft-spoken man with a heart of gold, who was also a registered nurse and a paramedic. For the last two years, he volunteered at the academy as an instructor.

Two other firefighters had minor injuries and are OK. Two adults and two children were displaced after the fire, all of them are OK.

The fire investigation team is working to determine a cause of the fire.
