Working fire in Joliet, 9-25-22

Excerpts from the patch.com:

A fire was reported at 4:02 p.m. Sunday at 69 North Chicago St. in Joliet. When firefighters arrived, flames were coming from the third floor of the vacant building, and there was also fire on the second floor.

Access to the third floor was closed off, so firefighters had to cut through the second floor ceiling. The roof was ventilated and both floors were checked for extension.

Joliet firefighters were on the fire scene for at about 90 minutes. The cause of the remains unknown.

Oak Forest Fire Department news

Four people are dead after what police say was a domestic incident on Friday morning in which gunfire could be heard and the house where the suspect fled caught fire in Oak Forest.

Police say when they responded to the call, they found three people with gunshot wounds outside the house. The victims were rushed to area hospitals, where they were pronounced dead.

A person believed to be the suspect went into the house, which caught fire. After firefighters extinguished the blaze, police found the body of the suspect.

No information has been released about any of those who died or how the person in the house died.

Lockport Township Fire Protection District news

An Illinois fire department has filed suit against Seagrave Fire Apparatus, LLC, alleging breach of contract, breach of warranty, and violation of the state’s “lemon law” due to problems with a new 105-foot Apollo aerial platform. The Lockport Township Fire Protection District filed suit today in US District Court for the Northern District of Illinois.

The Seagrave Model TP7KCT Marauder 105’ Apollo Quint rear mount platform was ordered in 2020, along with a Seagrave Marauder pumper. The aerial platform was delivered in March of 2022, but has been plagued with a number of mechanical problems outlined in the complaint. These include:

  • On April 10, 2022, the ladder failed to be stowed properly. Additionally, the raise and lower valve handle failed.
  • The following day, after setup, an outrigger drifted, twisting the pin—causing 360° rotation at approximately 70’ ladder extension, 50° incline, with two men in the air. LTFPD immediately suspended training.
  • On April 14, 2022, LTFPD held conference call with Seagrave to discuss issues. Seagrave blamed hydraulic issues—correctible with programing.
  • One week later, Emergency Vehicle Technician and Fleet Mechanic Brian Fisher (“Fisher”) and Seagrave identified sensor issues and adjusted the programing. However, they were unsuccessful in recreating April 11, 2022 drift issue.
  • On April 22, 2022, training resumed.
  • The following day, while operating the lift from side to side, the “green” light that indicates that the outrigger is planted would not illuminate. Upon further testing and inspection, Fisher thought the problem was resolved; however, he quickly noticed puddle(s) of hydraulic fluid on the garage floor apron.
  • On April 27, 2022, the Apollo platform was returned to Seagrave to be inspected.
  • After two weeks, repairs were made and the Apollo platform was returned.
  • On May 16, 2022, Fisher advised LTFPD repairs were done and the training continued.
  • On June 2, 2022, the Apollo platform went into full service.
  • On June 8, 2022, LTFPD found broken wear pads and old bolts that were left in outrigger channel(s).
  • On June 14, 2022, Fisher, who was replacing faulty sensors, found motor bolts to be “hand-tight.” LTFPD cut off the Apollo platform from service indefinitely.

On June 17, 2022, Fire Chief John O’ Connor informed Seagrave that LTFPD considered the device to be “unsafe and inoperable for use” and sought to return it for a full refund of $1,369,220.00. The President and CEO of Seagrave, Ulisses D. Parmeziani, disagreed that the device was unsafe or inoperable, but offered to repurchase truck for “fair market value.”

LTFPD engaged legal counsel and countered by demanding that Seagrave:

  • accept return of Apollo platform and refund $1,369,220.00 for the Apollo platform; or
  • deliver Apollo platform to an agreed upon qualified third- party inspector to be paid at Seagrave’s expense; agreed to pay the repair bills/costs to be completed by an independent vendor; return Apollo platform to LTFPD at Seagrave’s expense; extend Seagrave Limited Warranty three (3) years from date all issues are resolved; reimburse LTFPD for their legal bills incurred.

According to the complaint, when Seagrave failed to respond to the attorney’s demands, they opted to file suit. The four count complaint alleges breach of contract, breach of express warranty under 810 ILCS 5/2-313, breach of express warranty of material and workmanship, and breach of Illinois’ New Vehicle Buyer Protection Act (815 ILCS 380).

Chicago Mayor Lori Lightfoot was accused Thursday of scrapping a Chicago Fire Department promotion list — and saddling taxpayers with excessive overtime costs — to get even with a controversial city council member who was second in line to be promoted.

Last year, Lightfoot lashed out at Ald. Jim Gardiner over profane, threatening, and misogynistic text messages he sent to people, including Lightfoot’s political consultant and chief of staff to Finance Chairman Scott Waguespack . Lightfoot also asked then-Inspector General Joe Ferguson to investigate.

One week later, Gardiner rose on the council floor to issue a rare public apology for the embarrassment his messages caused. He received a rare rebuke from the Cook County Democratic Party and remains under federal investigation for allegedly retaliating against some Northwest Side constituents for political purposes.

Now, Gardiner is turning the tables on Lightfoot — with a recent lawsuit to back up his claim. He is a Chicago firefighter on a leave of absence from the department. He said the mayor, with whom he has clashed repeatedly, tossed CFD’s 2009 promotion list simply because he was second in line to move up to the rank of lieutenant. The list has been up since 2013. CFD policy is to exhaust the list before putting up a new one.

David Barron and Michael Lynch, two white firefighters awaiting promotion to lieutenant filed a lawsuit Aug. 30 in Cook County Circuit Court accusing the city of violating their rights by scrapping the list and suspending promotions, even though there were 40 vacancies as of April — and even more now.  That has forced firefighters to work excessive amounts of overtime while the city races to finalize a new list from a lieutenants’ exam administered by the city in 2019, the firefighters’ attorney said.

The hiring plan requires the city to document the reason for retiring the promotion list. But, in response to a Freedom of Information Request filed by one of the aggrieved firefighters, the city responded that no such document existed.

The lawsuit, which an attorney hopes to turn into a class action, seeks promotions, back pay, and lost seniority for the roughly 60 firefighters whose names appear on the now-scrapped list.

Gardiner himself faces two federal lawsuits. One accuses him of harassing, intimidating and falsely arresting a constituent who picked up a cellphone Gardiner’s ward superintendent left at a convenience store. The other accuses him of violating the First Amendment rights of 45th Ward residents by deleting their criticisms of him from his official Facebook page. The city has refused to represent Gardiner in either suit.

Though one of his obscene text messages suggested otherwise, Gardiner has maintained he has “never withheld, nor have I ever instructed or condoned my staff to withhold city services from any resident.”

It’s not the first time Gardiner and Lightfoot have clashed. Shortly after taking office, Gardiner accused the mayor of rewarding his vanquished predecessor John Arena with a $129,996-a-year job in the Department of Planning and Development.

A few months later, Arena resigned from that post after Gardiner accused him of using his job as city planner to continue fighting the man who beat him.
